Purpose
The purpose of this policy is to ensure that all information collected from our clients are protected and treated as private and confidential by South Coast Community Services (SCCS). This policy also describes the types of information we may collect from our clients.
Policy

SCCS respects the privacy of all our clients and prospective clients. Security is a top priority as a HIPAA compliant agency and HITRUST certified. The Protected Health Information (PHI) and Personal Identifiable Information (PII) and are protected through compliance with all our policies on confidentiality of information. This policy describes the types of information we may collect and our practices for collecting, using, maintaining, protecting and disclosing information.

This policy does not apply to information collected by any other parties and their means even if they purport to be representing SCCS.

All clients and/ or their legal representatives are expected to carefully read and understand this policy and our practices which are published on the SCCS website at www.sccs4kids.org. For any clarification, it is expected that the client or any of the legal representatives approach a member of clinical management to discuss any aspect of the policies and practices. Clients and/or legal representatives are expected to check the privacy policy periodically on the website for updates. Any changes posted on the website is deemed to be accepted if no request for clarifications are brought up.

Disclosure of Information

We may use and disclose protected health information when required by Federal, State, or local law. For example, the secretary of the Department of Health and Human Services (DHHS) may review our compliance efforts which may include seeing a client’s PHI.

Only relevant personal and private health information may be disclosed to those part of the treatment team, for continuity of treatment and under a covered entity.

We may also disclose personal information to comply with any court order or any legal process, including responding to any government or regulatory request. PII and/or limited and necessary PHI may be released in accordance with provisions specified in our Notice of Privacy Practices. Payers will have the right to request for the client’s relevant information to enforce or apply our terms of use and other agreements, including for billing and collection purposes.

Accessing and Correcting Client Information
Clients may send us an e-mail via our contact link to request access to, correct or delete any personal information that have been provided to us by the client or the legal representative. Once enrolled in any of our programs at SCCS, we cannot delete personal information. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
California Health Care Privacy Law
Under the California Confidentiality of Medical Information Act (CMIA), patient medical records may not be disclosed without authorization unless disclosure is required for litigation or is required to communicate important medical information to other healthcare providers, insurers, and other interested parties.
Changes to Our Privacy Policy
It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our clients’ personal information, we will send out a notification by electronic mail to the e-mail address specified in the client’s record and/or through a notice on the website. The date the privacy policy was last revised is identified at the top of the page. Clients are responsible for ensuring we have an up-to-date active and deliverable e-mail address. Clients or their legal representatives are expected to periodically visit our website to check for any changes.
